Terms of Use

By downloading, installing, or using HivRa, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app. These terms apply to all users of HivRa, including users who access the app without creating an account.

You must be at least 16 years of age to use HivRa. By creating an account and using the app, you confirm that you meet this age requirement. HivRa does not permit users under 16 to register, create an account, or access any features of the app.

Date of birth is collected during onboarding solely to verify age eligibility and to calculate personalised wellness metrics such as calorie targets. If our records indicate that a user is under 16, we will immediately restrict access and delete any associated account data.

If you are a parent or guardian and believe your child under 16 has created an account, please contact us at hivrasupport@gmail.com. We will promptly investigate and permanently delete the account and all associated data upon verification.

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You agree to notify us immediately at hivrasupport@gmail.com if you become aware of any unauthorised use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

You may only create one account per person. Creating multiple accounts to circumvent rate limits or any other restriction is a violation of these terms and may result in account termination.

You agree to use HivRa only for its intended purpose: personal wellness tracking, meal planning, and grocery list management. You agree not to:

HivRa provides AI-generated meal recommendations powered by the Groq/Llama language model. These recommendations are provided for informational and convenience purposes only.

AI recommendations are not medical or nutritional advice. They are not a substitute for advice from a qualified healthcare professional, registered dietitian, or nutritionist. HivRa makes no representations or warranties regarding the accuracy, completeness, suitability, or safety of any AI-generated recommendation for any individual user.

You acknowledge that:

HivRa, its developer, and any affiliated parties shall not be liable for any health outcomes, adverse reactions, injury, or harm resulting from following AI-generated meal recommendations.

HivRa provides workout tracking, calorie estimation, and fitness-related features for personal tracking purposes only. Nothing in HivRa constitutes medical advice, diagnosis, or treatment.

You acknowledge that:

HivRa, its developer, and any affiliated parties shall not be liable for any injury, health outcome, or harm arising from use of the fitness tracking or workout features.

HivRa requests access to Apple HealthKit data including step count, active calories, and heart rate. You grant this permission voluntarily through iOS system prompts. You may revoke this permission at any time via iOS Settings. HivRa will continue to function without HealthKit access, though some features will have reduced personalisation.

When you share a grocery list with another user, you understand and agree that:

HivRa enforces a limit of 15 AI meal recommendations per user per calendar day. This limit exists to ensure fair access for all users and to manage operational costs. Attempting to circumvent this limit - including by creating multiple accounts - is a violation of these terms.

If the AI service is unavailable, HivRa may provide recommendations from a static fallback corpus. The quality and personalisation of fallback recommendations may differ from AI-generated ones.

HivRa and all content, features, and functionality within it - including but not limited to the app design, logo, icons, and code - are the property of Hiba Begum and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of HivRa without explicit written permission.

You retain ownership of content you create within HivRa, including recipes, meal plans, and grocery lists. By storing this content in HivRa, you grant us a limited licence to store, process, and display that content solely for the purpose of providing the app's features to you. We do not claim ownership of your content and will not use it for any other purpose.

We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms of Use, engage in abusive behaviour, or use the app in a way that harms other users or the service. You may delete your account at any time via Profile → Settings → Delete Account.

Upon termination, your right to use the app ceases immediately. All your data will be deleted in accordance with the Privacy Policy.

HivRa is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content within the app.

To the fullest extent permitted by applicable law, HivRa and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages - including but not limited to loss of data, health outcomes, personal injury, or financial loss - arising out of or in connection with your use of the app, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of HivRa shall not exceed the amount you paid to use the app. Since HivRa is free, our total liability is zero to the extent permitted by law.

You agree to indemnify, defend, and hold harmless HivRa and its developer from and against any claims, liabilities, damages, losses, and expenses - including reasonable legal fees - arising out of or in any way connected with your use of the app, your violation of these Terms, or your violation of any rights of another user.

These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to its conflict of law provisions. Any dispute arising from these terms shall be resolved in the courts of that jurisdiction.

We reserve the right to modify these Terms of Use at any time. When we do, we will update the effective date at the top of this page. Your continued use of the app after changes are posted constitutes your acceptance of the revised terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms of Use and our Privacy Policy constitute the entire agreement between you and HivRa regarding your use of the app and supersede any prior agreements.
