By using VoxDeck you agree to these Terms of Use. VoxDeck's hands-free study mode is designed to reduce the need to look at or touch your device, but it does not make driving while using any device completely safe. VoxDeck's AI features - answer grading and card generation - are provided for study convenience only, may be inaccurate, and require sending your text (a transcript of your spoken answer, or the question and explanation you enter) to an external third-party large language model provider, Groq, Inc. You are solely responsible for using the app in compliance with local laws and for your own safety and the safety of others.
1. Acceptance of Terms
By downloading, installing, or using VoxDeck, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app.
2. Eligibility
You must be at least 13 years of age to use VoxDeck. By creating an account, you confirm that you meet this age requirement. If you are a parent or guardian and believe your child under 13 has created an account, contact us at hivrasupport@gmail.com and we will investigate and delete the account.
3. Account Registration
VoxDeck requires an account, created with an email address and password via Firebase Authentication, to use the app. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hivrasupport@gmail.com if you become aware of any unauthorised use of your account. You may only create one account per person.
4. Driving and Safety Disclaimer
VoxDeck's hands-free study mode is intended to let you review flashcards audibly while your hands and eyes are occupied with another task, such as driving or exercising. This feature does not eliminate the risks of distracted driving.
You acknowledge and agree that:
- You are solely responsible for complying with all applicable laws regarding phone and device use while driving in your jurisdiction, including hands-free device laws
- You should not interact with the app's screen, adjust settings, or attempt to correct spoken answers while operating a vehicle
- VoxDeck is a study aid, not a certified hands-free driving accessory, and the developer makes no representation that use of the app while driving is safe or legal in your location
- You assume full responsibility for any accident, injury, citation, or other harm arising from your use of VoxDeck while driving or operating machinery
- If using the app becomes distracting at any point, you should pull over safely or discontinue use until you are no longer driving
VoxDeck, its developer, and any affiliated parties shall not be liable for any accident, injury, property damage, legal penalty, or other harm resulting from use of the app while driving or in any other setting requiring your full attention.
5. Acceptable Use
You agree to use VoxDeck only for its intended purpose: personal flashcard study. You agree not to:
- Use the app for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to reverse engineer, decompile, or extract the source code of the app
- Attempt to bypass, disable, or interfere with any security feature of the app, including authentication or rate limiting
- Use automated scripts, bots, or other tools to make requests to VoxDeck's backend services, including the answer-grading and card-generation services
- Upload or create deck content that infringes another party's copyright or other intellectual property rights
- Upload, transmit, or create content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Attempt to access another user's account or data without their permission
6. Rate Limiting and Fair Use
VoxDeck enforces per-user daily limits on its AI features: up to 100 AI grading requests per user per day, and, separately, up to 100 AI card-generation requests per user per day. Each limit is tracked independently and resets each calendar day. These limits exist to ensure fair access for all users and to manage operational costs. Attempting to circumvent them - including by creating multiple accounts - is a violation of these terms and may result in account suspension or termination.
7. AI Features Disclaimer (Grading and Card Generation)
VoxDeck includes two optional AI-powered features. AI grading judges how closely your spoken answer matches a flashcard's correct answer, returning a verdict of correct, partial, or incorrect. AI card generation takes a question and an explanation that you enter, returns three suggested answer options, and lets you turn one or more of them into cards. Both features are provided for study convenience only.
You acknowledge and agree that, to provide these features, VoxDeck transmits your text from your device to VoxDeck's backend service and then to an external, third-party large language model (LLM) provider, Groq, Inc., whose servers operate outside VoxDeck's control. For grading, this text is a transcript of your spoken answer together with the card's question and correct-answer text; for card generation, it is the question and explanation you enter. This transfer occurs each time you use the respective feature. By using an AI feature you consent to this transfer and to the processing of that text by Groq under its own terms and privacy policy. If you do not want your text sent to Groq, do not use that feature. How this data is handled is described further in our Privacy Policy.
You also acknowledge that:
- AI grading may be inaccurate - it may mark a correct answer wrong, or a wrong answer right
- AI-generated answer options may be inaccurate, incomplete, misleading, or wrong, and you are responsible for reviewing any suggestion before saving it as a card
- Speech-to-text accuracy may degrade for technical jargon or in noisy environments, such as while driving, which can further affect grading accuracy
- Automated grading and generation are not a substitute for your own judgment or for review by a teacher, tutor, or study partner, especially when preparing for an exam or certification
- You are solely responsible for verifying your understanding of study material before relying on it for any high-stakes purpose
VoxDeck, its developer, and any affiliated parties shall not be liable for any exam outcome, academic result, or other consequence arising from reliance on AI-generated grading or AI-generated card content.
8. User-Generated Content
You retain ownership of the deck and card content you create in VoxDeck, including cards you build from AI-suggested answer options. By creating this content in the app, you grant us a limited licence to store, process, and - when you use the AI or hands-free features - synthesize speech from and transmit that content, along with your spoken-answer transcript and any question and explanation text you enter for card generation, to our backend service and on to Groq, Inc., solely to provide the app's features to you. We do not claim ownership of your content and will not use it for any other purpose. You are responsible for ensuring you have the right to use any material you add to your decks or submit to the AI features.
9. Intellectual Property
VoxDeck and all content, features, and functionality within it - including but not limited to the app design, logo, icons, and code - are the property of Hiba Begum and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of VoxDeck without explicit written permission.
10. Account Termination
We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms of Use or use the app in a way that harms other users or the service. You may delete your own account at any time by emailing hivrasupport@gmail.com. Upon deletion, your account credentials, decks, cards, and review history are permanently removed in accordance with the Privacy Policy. Deletion is irreversible.
11. Disclaimer of Warranties
VoxDeck is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy of any flashcard content, speech output, or AI-generated grading.
12. Limitation of Liability
To the fullest extent permitted by applicable law, VoxDeck and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages - including but not limited to loss of data, personal injury, accident, or academic loss - arising out of or in connection with your use of the app, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from your use of VoxDeck shall not exceed the amount you paid to use the app. Since VoxDeck is free, our total liability is zero to the extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless VoxDeck and its developer from and against any claims, liabilities, damages, losses, and expenses - including reasonable legal fees - arising out of or in any way connected with your use of the app, your violation of these Terms, or your violation of any rights of another party.
14. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflict of law provisions. Any dispute arising from these terms shall be resolved in the courts of that jurisdiction.
15. Changes to These Terms
We reserve the right to modify these Terms of Use at any time. When we do, we will update the effective date at the top of this page. Your continued use of the app after changes are posted constitutes your acceptance of the revised terms.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms of Use and our Privacy Policy constitute the entire agreement between you and VoxDeck regarding your use of the app and supersede any prior agreements.
